Nicholas Sheley will not face another trial for aggravated battery in Knox County. The case was dismissed in court on Monday.
Sheley is accused of killing eight people in Illinois and Missouri in 2008. In the battery case he was sentence to seven years for throwing a chair at a jailer.
An appeals court ruled the trial court erred, finding Sheley suffered from a severe mental illness that prevented him from preparing his own defense.
Sheley has already been convicted of killing a Galesburg man and faces another murder trial in September in Whiteside County.
