On November 16, 2012, a jury in Whiteside County found Nicholas Sheley guilty of first degree murder for the June, 2008 killing of 93-year-old Russell Reed. Now, Sheley's lawyer wants that decision thrown out.

In a motion filed on December 26, 2012, attorney Jeremy Karlin sighted 86 reasons for a new trial.

Among these, the motion claimed that the court erred in not ordering a fitness examination of Sheley prior to trial after a change in his psychiatric medication.

Karlin also argues the trial should have been moved out of Whiteside County and the extended media coverage shouldn't have been allowed.

The motion is scheduled to be heard on January 16, 2013, the same day Sheley is scheduled to be sentenced.
