A juror has been dismissed in the fourth day of the Nicholas Sheley trial. Apparently the juror had made a comment to himself that another juror overheard. He reportedly said that the defense didn't have much of a case.  
After learning about the comment, Sheley's defense attorney Jeremy Karlin again asked the judge for a mistrial.
 
"This is not the proper venue for this case," Karlin said. "We have two and a half days of evidence and we have people thinking that Mr. Sheley is guilty and area already determining that," he added. Chief Judge Jeffrey O' Conner ruled to dismiss the juror who made the comment and to bring in the first alternate. Testimony resumed.
