Sheley Trial Day 5: Video Testimony And Judge Falls Asleep During It

Video testimony in court today, from a gas station attendant who says she saw Nicholas Sheley with blood on his face.

But coming back from a courtroom recess... defense attorney Jeremy Karlin asks to put on the official record that Chief Judge Jeffrey O'Connor fell asleep during testimony.

"I can state for the record, there's nothing in this record I'm not cognizant of," said Judge O'Connor.

Karlin said he had tried to get the judge's attention from his table and when the judge didn't respond, he was concerned.

Judge O'Connor said there were no "physical inabilities" he was aware of that he had and allowed court to resume.

He nodded off during video surveillance testimony, which showed gas stations in Galesburg leading up to the deaths of four people in a Rock Falls apartment.

One of those testimonies was from a woman who has since passed away. She worked at the Hy-Vee gas station in Galesburg and waited on Sheley... covered in blood.

"I just saw him looking down at his hand were shaking really bad getting his money out and I looked up at his face and he had blood all over his face," said witness Pamela Sebben.

Now, in regards to the judge falling asleep, Karlin did not say why this could mean for the case. So we don't know if this could mean a cause of appeal or mistrial.

Testimony will resume on Tuesday and is expected to wrap Wednesday.

Sheley was previously convicted in the murders of Ronald Randall of Galesburg and Russell Reed of Sterling.

Sheley is on trial for four murders in a Rock Falls apartment, Kilynna Blake and her 2-year-old son Dayan, Kilynna's boyfriend Brock Branson and their friend Kenneth Ulve.

He still faces charges in the deaths of Tom and Jill Estes from Arkansas. Their bodies were found in Missouri.
